1. Acceptance of Terms

By accessing our website, registering directly in our platform, and/or downloading the ViajeListo mobile application, you are establishing a binding agreement with our corporation and legally accepting to be bound by these Terms of Service. Disagreement with any clause invalidates your authorization to utilize the logistical software space provided by us.

2. Service Description

ViajeListo is a highly sophisticated Software as a Service (SaaS) tool geared toward the mathematical optimization of routing, last-mile geographic design, and assisted 3D navigational layouts for independent couriers or massive corporate delivery fleets.

3. Driver Safety and Legal Liability

Our application is strictly designed as an informative assistance tool and must never replace the absolute judgment of a human driver.

• Manual interaction (such as typing addresses, deep menu diving, or route overriding) with the ViajeListo user interface is heavily forbidden whilst the delivery vehicle is in active transit.
• Our core commercial promise revolves around fuel and time-saving mechanisms generated by Predictive AI models. However, ViajeListo assumes absolutely zero liability for delayed logistical arrivals caused by unmapped physical roadblocks, third-party vehicular accidents, traffic rule infringements, or undocumented localized street closures.
• Any execution of illegal action, transport of unauthorized goods, or reckless driving performed while the software calculates your route, totally exempts our development platform of involvement. We limit ourselves solely to deploying the computational compass grids.

4. ViajeListo Intellectual Property

The core structural source code, intelligent routing algorithm frameworks, web platforms, the brand "ViajeListo", associated typographic logos, and our proprietary User Interfaces (UI) represent strictly enforced intellectual property. Reverse engineering the application, attempting malicious data extraction, or executing API traffic resales designed primarily to replicate and compete with our tool natively is inherently prohibited and subject to permanent legal sanctions.

5. SaaS Subscriptions and Payment Gateways

Advanced computationally intensive modules (e.g. processing matrixes for hundreds of simultaneous stop layers) are accessed safely entirely through periodic App Store or Web subscriptions. ViajeListo reserves full rights to actively adjust these price structures assuming clients receive prior mail communications with explicit opportunities to securely cancel related auto-renewals at all times.

7. User Generated Content (Proof of Delivery)

When utilizing ViajeListo's interface to capture photographs functioning as "Proof of Delivery", you explicitly warrant that you possess the native legal right to capture and upload those images. You grant ViajeListo a non-exclusive, global license strictly to host and relay these materials for logistical operation protocols within your corporate cloud pipeline.

8. Disclaimer of Warranties ("As Is" Clause)

The ViajeListo platform is provided entirely on an "As Is" and "As Available" foundation. We natively disclaim all implied or explicit warranties guaranteeing that secondary mapping APIs or deep routing algorithms will remain permanently 100% error-free, uninterrupted, or without localized network latencies. We hold absolute immunity against claims regarding lost profits, commercial penalties, or disrupted cargo flows due to AWS or Google node downtimes.

9. Indemnification Protocol

You agree to legally defend, fully indemnify, and explicitly hold formally harmless ViajeListo, its internal developers, corporate executives, and subsidiaries from any third-party claims, massive damages, or lawsuits natively arising out of your improper structural use of the Application, violations against these Terms, or local traffic law infringements.

10. Applicable Law and Corporate Jurisdiction

These formal Terms and Conditions are universally governed independently of conflicts of law principles. Any unresolvable legal dispute formally arising from the utilization of our software or algorithms will be submitted explicitly under the jurisdiction of the corporate commercial courts corresponding to ViajeListo's primary global headquarters.
